NEW DELHI: A court here has dismissed a woman's complaint against her in-laws under the domestic violence law, saying she could claim right of residence and maintenance only from her husband. Metropolitan Magistrate Nirja Bhatia rejected the application on the ground that the woman's husband was maintaining a separate residence and a perusal of records showed that he was capable of providing a life of dignity and peace to her.

Neetu filed a complaint against seven members of her husband's family under the Protection of Women from Domestic Violence Act, seeking compensation of Rs five lakh for mental agony and harassment and alimony.

She accused them of torturing her for bringing insufficient dowry and contended that she was thrown out of her matrimonial home on June 16 last year.

Neetu, a mother of three, however, did not implead her husband, who had been reportedly living separately from her for some time. She claimed he earned very little, a plea that did not go down well with the court.

Citing an apex court judgement, the court held that the complainant had the right to claim residence and maintenance from her husband and not from her in-laws.

The court further relied on the report of a protection officer, who proved that Neetu used to pay monthly rent to her mother-in-law when the couple lived in their matrimonial home in north Delhi. Neetu's status in the matrimonial home was "not due to the factum of her relationship arising out of consanguinity with her mother-in-law" but because of an independent contract as landlord and tenants, it said.

"The said fact (of her paying the rent) has been concealed in the complaint which does not disclose any reason for the complainant to ask for maintenance or monetary compensation," the court held.

MORDABAD (UP): A case under the Anti-Dowry Act has been registered against Union HRD Minister Arjun Singh, his wife Beena Singh, son Abhimanyu Singh, grandson Abhijeet Singh and three others at a police station on Sunday, police said.

The case has been registered on the direction of Additional Chief Judicial Magistrate, Chandausi, on a complaint by Madhvendra Singh, the father of the Union Minister's daughter-in-law Priyanka Singh, Moradabad district police chief Prem Prakash said.

The court had ordered the registration of the case on July 27 but the FIR was registered at Chandausi Kotwali police station on Sunday, he said.

Madhvendra Singh has alleged that his daughter's in-laws had been demanding a Mercedes car and a flat from him and his daughter was being tortured when their demand was not met, Prakash said.

The case has been registered on orders from Additional chief judicial magistrate Chandausi, after a complaint by Madhvendra Siingh, father of the union minister's grand daughter-in-law Priyanka Singh.

Madhvendra Siingh alleged his daughter was being tortured and her in-laws had asked her to get a Mercedes car, among other things.

After the quota controversy, in an embarassing development a case under the Anti-Dowry Act has been registered against the Union HRD Minister, his wife Beena Singh, son Abhimanyu Singh, grandson Abhijeet Singh and three others at a police station in Moradabad.

A case against the Singhs has been registered following a complaint by Madhvendra Singh, the father of the Union Minister's daughter-in-law Priyanka Singh. Madhvendra Singh has alleged that Arjun Singh's family had been demanding a Mercedes car and a flat from him and his daughter was being tortured when their demands were not being met.

Tenzin Dechen, Hyderabad:  We have all heard of women who are abused by their husbands and in-laws.  It is for these unfortunate victims that the Protection of Women From Domestic Violence Act (DVA) was passed in October 2006.  However, it seems that the Act can be easily misused against men. 
 
Previously, the legal options available to victims of domestic violence were to file for divorce or register a case under Section 498-A of the IPC for dowry harassment.  The DVA includes not only marital relationships but also recognises any kind of 'domestic relationship'. 
 
Under this Act, domestic violence is define as any act that harms or threatens to harm in sexual, physical, emotional, verbal, psychological and economic ways.  To help abused women and children, the government has appointed Protection Officers who can be approached after even a single act of domestic violence.  Says Advocae Venkatappa Reddy, "My client was the defendant in the first case under the Domestic Violence Act at Ranga Reddy court.  His wife made several allegations ranging from dowry harassment to physical abuse.  After a full length enquiry, the judge refused to accept the allegations.  The problem is that women can go to the Protection Officers even for the smallest problems and only after a full enquiry (trial) it can be known if the allegations are false." 
 
A woman can grossly misuse the Domestic Violence Act by simply filing false complaints to harass her husband, says Advocate Jayashree Sarathy.  "I have a client from Chennai whose wife has filed several criminal and civil cases against him here in Hyderabad although she left him in 2002 after a year of marriage.  So he has no choice but to travel here for the hearings." 
 
While in other cases the accused has to be proved guilty, it is the man who has to prove himself innocent in these cases.  "All these years we have been dealing with abused women so the laws are biased in their favor," says Advocate Ajaya Kumari. 
 
According to retired High Court Judge B.S.A. Swamy, even Section 498-A is grossly misused.  "A lady filed a chargesheet against her husband for harassing her when he wasn't even in the country.  While there are genuine victims of violence, in my experience, I have seen umpteen number of false cases which misuse the law," says the retired judge. Day of the detective

The fate of many a marriage in urban India rests on detectives, who are no longer just characters playing a part in thrillers. Detectives today are being approached to spy on matters big and small, issues personal and professional. Be it for checking on spouses, pre-marital screening, employee verification, update on a business rival or uncovering cyber crime, the reasons for hiring a sleuth are many and varied. Vibha Sharma trails the desi detectives


Price for probing

Private investigation comes at a price, depending upon the case and circumstances. The price tag for a pre-matrimonial surveillance can be anywhere between Rs 10,000 and Rs 20,000. But if the person under investigation is an NRI, the fee can range from $1,000 to 3,000. Post-matrimonial checks are generally more complicated and tricky. Therefore, depending upon the investigation, a client may be charged Rs 30,000 onwards. "The person may have to be kept under surveillance for weeks, for which more than one team has to be involved," Kunwar Vikram Singh explains. Regarding employee background check, for one employee the charges can be as less as Rs 2,000 but if it involves a high-up like a CEO, the investigation can cost between Rs 25,000 and Rs 50,000. Pre-joint venture investigations for foreign companies wanting to invest in India come at $7,000 to $10,000 depending upon the scope of investigation. Investigations on IPR, fake medicines or products cost around Rs 2 lakh.

Spy, detective, sleuth or secret agent. Whatever you decide to call them, the very word implies danger, intrigue, and enemies. Their job is to obtain information. From tracking down an errant husband or a two-timing wife to shadowing corporate, business or political rivals or verifying credentials of prospective employees, sleuthing is big business today. Large corporations spend a lot of money on precautions and protective countermeasures. There are parents who want to keep an eye on their sons and daughters and want to know who they meet once they step out of the safety of their homes. At times it is also the other way around.


It was a change in the behavioural pattern of his wealthy widower father that led Atul Saxena to employ a full-time sleuth to tail him. The detective took just two days to find that Saxena senior was involved with a pretty young thing, less than half his age. After some active digging on the PYT's not-so-perfect past, followed by aggressive persuasion from Atul, Saxena senior agreed to try his luck with someone closer his age.


What was once a part of fiction is now becoming very much a part of life for the urban middle class if the increasing number of detective agencies and spy gadgets is anything to go by. Not only business rivals or corporates but also lovers, spouses, parents and even youngsters are hiring detective agencies to verify and spy on one another. Perhaps it is the mark of the times that relationship are based on — not on trust.


A few months back Smita Narula, married for barely two months, contacted Ashish Mathur of Trident Investigation Network. She had a doubt that her husband Chetan was having an extra-marital affair. The basis of her doubt was that he appeared to be spending more time than was required to reach his office in Gurgaon from Delhi and back. Smita also felt that whenever she tried calling him on his mobile during this period, he would either disconnect the phone or was very brief.


What emerged after Mathur launched the surveillance is quite interesting. Apparently, Chetan had misinformed his in-laws about his job profile and the salary he was drawing. So, while the car he was driving to work was part of his wife's dowry, the money he was earning did not permit him to maintain the vehicle. Therefore everyday he would park the car in AIIMS parking, catch a bus to Gurgaon and after finishing work pick it up and drive back home. The reason he was reluctant to talk to his wife was because he didn't want her to overhear the background noises while he was on the bus. Simple.


Is the moral of the story that marital doubts are often misplaced? "No", says Association of Private Detectives of India (APDI) chairman Kunwar Vikram Singh, a two-time winner of the best investigator in the world. "Ninety per cent of the cases where the wife suspects her husband or vice-versa prove to be correct," he says. Mathur agrees: "This was a freak case because more often than not a partner's suspicion is generally correct."


Singh, who also heads Lancers Network Ltd, recalls a particular incident where a man approached them insisting that his wife was having an extra-marital affair and wanted her watched. "He asked us to watch her at home during the time he was out between 9 am and 6 pm. We did that for two months and found nothing wrong. We assured him that he had no reason to be suspicious but he insisted that though his wife's behaviour appeared to be proper, he felt something was fishy. The next day we followed her when she went to drop her son to school. And sure enough after dropping the child, she took a detour and went to meet someone, who we later discovered was her boyfriend in college," he says. In most cases, Singh admits, "the feeling" is generally right.

Exactly, because it was only after Ritu Anand got the feeling that her lover's promises about his intentions being honourable were not so that she decided to approach a detective agency. What detectives found became the most horrifying revelation of her young life. The man was married and had a one-year-old child. "His having a one-year-old child was the final blow. But at least I found out before it was too late," says Anand, who had to undergo psychiatric treatment after this traumatic experience.

Does this mean it pays to be prudent and extra cautious, especially in these marriage dotcom days. "The problem is that the joint family system has disintegrated and checking the antecedents of prospective brides or grooms is difficult," says Singh, recounting the case of an Army nursing officer who was lured into a relationship by a Kolkata-based married businessman, claiming that he was divorced. "Surveillance revealed that not only was he married, but being a businessman who travelled a lot, this was also his modus operandi. He would insert a matrimonial ad in regional papers saying he was divorced, establish a relationship and then leave the girl saying that his divorce proceedings were not through."

In NRI marriages in particular, getting a backgrounder of prospective grooms makes sense as it can save heartbreak later. Take the example of Simran Grewal, who got married 10 years ago to a New-York based "doctor" but is still waiting for him. In Punjab, Grewal's story is common. After making endless trips to police stations, women NGOs and government officials, she decided to get him investigated. "There was no trace of him in India and the detective agency said investigation in the US would cost a lot of money. I felt it was better to save whatever little money I had for the future of my daughter," she says, strongly recommending that parents should make detailed inquiries about NRI grooms.

Big business

There are several agencies operating in India, dealing in business and personal cases. They promise background checks, character screening, corporate intelligence and analysis, pre and post-employment screening, undercover operations and infringement of trademark, copyright and patent besides assets verification. They also help obtain proof and evidence for insurance cases, offer debugging services, trace missing persons and do audio and video surveillance and handwriting authentication.

Business for detective agencies is growing, thanks to increasing permissiveness followed by rising awareness in this nation of one billion. The number of couples having a good time outside marriage has increased and so has the business of detective agencies, courtesy the increasing number of hurt spouses who now have resources and facilities to bring erring partners to book. Some detective agencies, particularly the cyber types, are flooded with requests of hacking e-mails and procuring the proof of their spouse's infidelity for the convenience of divorce lawyers who will need them as evidence for getting their clients a suitable deal.

Infidelity cases

Many involved in the business may not like to admit it but the services most in demand are pre and post-matrimonial verification, alimony and divorce cases, spouse fidelity, litigation support besides, of course, corporate surveillance.

In pre-matrimonial investigations, credentials presented at the time of alliance are verified, followed by background checks to confirm the "character and trust worthiness of the individual concerned." Post-marital investigation includes cases of adultery, extramarital affairs or suspected activities and day-to-day tracking. "Women by nature are more suspicious than men hence the number of women asking for keeping tabs on their husbands is more. Also now they are financially more empowered and are aware of their rights and refuse to take any nonsense from their erring husbands," Singh explains.

Corporate intelligence

Cases for corporate intelligence are growing because with the opening up of economy, the number of foreign investors in India is increasing. "Companies and investors now want a due diligence before committing. There have also been several cases of data theft from BPOs and companies also want to find out who are involved in these nefarious activities. It also makes perfect sense for MNCs to know their rivals' moves in advance," Singh says.

Pre and post-employment checks are also gaining ground. MNCs regularly get their employees checked before offering letters of intent and want to know everything, right from work attitude, habits, performance rating, social wellbeing, family and friends circle of their employees.

Employees too like to make their own inquiries, especially about the immediate boss. For example, Rahul Gupta, before joining a well-known media group as a top executive, went to great lengths to find out the behaviour of his immediate boss and also why the person before him had left the job. "I wanted to know whether I would be able to gel in the new set-up. Also, why did the guy before me leave if the company was so good, especially when he himself approached me to take up the job," Gupta explains.

Know your spy

Now if you think the detective you have employed will come in a package reminiscent of some debonair gun-totting character with fast cars, beautiful girls et al — a la James Hadley Chase — banish the thought. Even the very conservative Sherlock Holmes or our desi Agent Vinod are nowhere close.

On silver screen, detectives and spies have been romanticised as knights in black ties, hats and dinner jackets who solve mysteries with their brains, muscles and sex appeal. In real life, being on the job means a lot of hard work. It requires a lot of effort to get to the bottom of the story.

An average detective, though cool and confident, also sports non-attention-seeking mannerisms and attire that make him blend with the crowd. "We do not even want someone with a turban in Delhi, let alone any other outstanding paraphernalia," Mathur says. And apart from physical well-being and quicksilver responses, qualities like integrity, honesty, courteousness and a vigilant nature are welcome. "The effort should be to create no controversy while on the job," he adds.

Since private investigators do not have any authority under law to detain or interrogate anyone or gather proof, they resort to ingenious methods to gather information and investigate the case. At the end of the assignment, they hand over a detailed report to the client and if the client needs a proof that can be submitted in the court of law, it is prepared in such a way.

Hi-tech gadgets

To aid a detective in his job are a collection of sophisticated technological advances like miniature wiretap detectors and telephone-recording equipment, eavesdropping bugs, electronic stethoscope, amplified hearing devices to detect even faint sounds and voices behind walls, miniature cameras fitted in cigarette lighters or pens and other gadgets.

Most agencies depend upon electronic surveillance and monitoring systems. "The nature of equipment used has more or less remained the same, the difference is that now they are smaller and smarter," says Singh.

With the advancement of technology, spies have been reinventing their tools and bulky equipment has given way to silicon chip in miniature devices that could capture and transmit vital intelligence. Today, it is the world of Internet surveillance, digitally sabotaging computer networks and cyber-spies.

There has also been a massive increase in the number of personal surveillance gadgets, particularly popular with litigating couples. For men there are smart briefcases with hidden microphone and tape recorder for taping conversations and promises that might otherwise be lost. Women can take the help of sleek designer recording purses to document sexual harassment at work or for nailing a spouse for verbal or physical abuse.

Video surveillance may also come in the form of cuddly teddy bears with a tiny camera peeking through its belly button or a seemingly conventional TV with a built-in video camera behind the speaker to keep tabs on what is going on in your bedroom while you are out. A cigarette case with a UHF transmitter that can record from a distance of more than 200 m, radio microphone in pens, surveillance and telephonic microphone to intercept voices, wall microphone behind a clock with highly miniaturised micro-transmitter, they are all readily available.

There are modified mobile phones to monitor calls with a surveillance microphone hidden in the battery. Give this spy phone to the person you want to spy on —your wife, partner, kids or employees— as a present. Whenever the spy phone is called from a pre-programmed telephone number, it will answer without ringing or flashing lights and you will be able to listen in.

Past and future

In modern India the history of private detectives can be traced back to the Gorkha watchmen concept. As crime and security threats grew, Gorkha watchmen made way for full-time business for security agencies, offering security cover to business establishments, showrooms, malls, educational institutions, housing societies and private homes with trained security men and a complete armoury of metal detectors and overhead miniature cameras. And as social fabric changed, political and domestic violence increased and foreign investment and corporate culture made a foray, the job profiles of these security agencies also multiplied.

The APDI is the apex organisation of private investigators with a pan-India membership of 180 but as per Singh there could be anywhere close to 1500 investigating agencies operating in India. "A majority of them provide security services and are not investigative agencies. Quite a few are also involved in shady activities. The APDI is a self-regulatory apex body with audit and ethics committees and when you choose a member of the APDI, you choose a professional company which works as per the association's code of ethics," he says.

The government, understanding the need for regulating private security agencies, brought in the Private Security Agencies (Regulations) Act, 2006. During the next monsoon session, the government is likely to introduce the Private Detective Agencies (Regulations) Bill 2007 to regulate the activities of investigating agencies and also ensure curbs on foreign investigating agencies operating in India.

In India as yet, detectives do not need a licence to operate. So no particular academic qualifications or background is necessary to enter the profession. But the APDI conducts training programmes and most agencies also offer in-house training.

Systemic dis functionality the abuse of Jyoti Mali - By Lucio Mascarenhas



There has been a huge hullaboo over a cheap woman making a spectacle of herself in Rajkot, even while the case of Jyoti Mali has met with silence. 
 
Jyoti Mali's case appeared only once in the Indian Expess, Bombay, and that was it; after that, deep silence. 
 
 
But the silence is deliberate, not accidental.  Jyoti Mali's case raises too many uncomfortable questions about the systemic disfunctionality of the Indian State. 
 
Firstly, it is the police who compounded and abetted the crime against Jyoti Mali by 'marrying' her off to her kidnapper.  The police also thereby acted in flagrant violation of the law, by kidnapping a minor, trading in a minor woman, and abetting bigamy, etc.  The list of crimes committed by the Calcutta Police in this one act is very long and needs a thorough professional and dispassionate investigation by a neutral body.  
 
Secondly, it is clear that Jyoti Mali was sold down the sewerlines by her own father and mother, who, instead of standing by her, surrendered to the criminality of her kidnappers and, together with the police, inflicted a far more greater crime on the girl.  
 
As the second news article makes clear, nobody, not the Calcutta Police, nor Jyoti Mali's parents, have learnt any lessons, or allowed Jyoti Mali's fate trouble their conscience in anything more than a cosmetic manner.  
 
Jyoti Mali needs justice, and this is not something academic.  All those who have committed the various crimes against her - the Calcutta Police, Parmalal Khatik & Co., Ashok & Buchi Mali, etc., - need to be prosecuted and prosecuted sternly and quickly, if Civil Society is to be rescued from the rot that it presently suffers from.

Sad to note that your case has reached this stage

- what are the charges ?

2. 1. Try for a Stay at the ____ (Indian STATE) High court on the entire case. A write petition can be filed wherein the High court's intervention is sought. Pray to the HC that you need x no of months to arrange your visa etc matters (in the foreign country) and after x no of months you would come to India to answer / appear before courts.

- trying to separate the husband from his parents,

- vengence
- trying to take away children and alienate them from the father
- even silly matrimonial disputes have resulted in false dowry cases

The sad part is the Husbands HAVE NOT joined together in LARGE NUMBERS and got down to street protests.

1) Woman torched alive in Aliabad 
Hyderabad, July 13 (Siasat News):

A woman Layeeqa was set ablaze for not bringing more dowry by her husband and other in-laws.

This incident took place at Hamalwadi in Aliabad.

Police said that Layeeqa, 22, was married to one Saleem Khan, a private employee just five months ago. After the marriage, her brother-in-law Nadeem and his wife Nazia started harassing and torturing her, as she was not paying any heed to their demand of the more dowry.

It is alleged that Saleem Khan had illicit relations with Nazia. On July 10,they poured kerosene on Layeeqa and torched her alive. She sustained severe burn injuries and died. Police Shahlibanda has registered a case. Further investigations are on.

I see the following in this latest move

- whatever women do ..including running naked on streets, FALSELY accusing husbands and their elderly mothers, getting them arrested etc etc etc... STILL YOUNG women are victims ... Young women are victims of this or victims of that and they NEED rehabilitation E.g. This Rajkot's semi nude walker pooja chauhan needs rehab !!

- Possibly feminist is also looking at a rehab industry and benefits from such a industry... NO prizes for guessing that such a rehab industry would be funded by TAX money - MOSTLY PAID BY MEN !! the POOR earning b@st.... of the punya bhUmi . Rehab industry is a multi billion dollar industry in the west. It mainly runs on bankrupting men to pay for foster homes and child care

- The case / community that this laborer came from rallied AGAINST THE WOMAN and FOR THIS MALE .... luckily the CASTE leaders saw reason ... Thank god they did... OR ELSE this husband and his people would rot in jail for ages

- Unless society as the caste in this case takes up cudgels FOR FAMILY, for our mothers and reins in these nude walking young women, we DO NOT SEE much salvation in the short run

- This case also conveys a powerful message L Men need to get down to street protests and counter offensive paper / media campaigns to win our rights.... there is NO other way..

This getting to the roots by NCW is a big SHAM!! They are only trying
to project a more balanced image for themselves given the amount of
extremism they have exhibited in the past (incidentally they continue to
carry on with their extremist attitudes; their future policies amply
prove so).

Except for these women's organisations, Pooja Chauhan has only drawn
flak from the masses. Such exhibitionism to make a point hasn't gone
down well with the population at large. If one can stoop to such levels
to make a point in public then what must she have done to have her way
at home??

NCW wants to get away with more in future, so they are doing their best
to extract a mileage out of Pooja Chauhan's case.

Reality is that any aggressive backing to Pooja Chauhan's case would
have only opened a Pandora's box for NCW. What if other women followed
suit and took to the streets the way Madam Chaudhan did?? The Indian
govt. in that case would have been shamed in the International community
and Sonia Gandhi would not have known where to look!! This obviously
would have brought the Ministry of WCD and its pet NCW in the direct
line of firing!!

So it was in the best interest of the govt. to nip the problem in the
bud. One therefore sees NCW playing down its earlier role and making
these 'no-dowry harassment' claims in the press.

Ultimately, its politics and vote bank at play. Otherwise who is
bothered about the real state of underprivileged in this country?
Atleast not NCW. In the name of women's development if they have brought women to such a level in terms of attitude (as Pooja Chauhan is) then such organisations only need to be banned. No question of any support.

May I request you to please post the following on your august pages as questions from harassed and victimised men

Now that the Govt funded and appointed Women's body - NCW, has clarified that POOJA was NOT harassed and
there are GREAT suspicions that she is MENTALLY IMBALANCED (another way of saying that was she was abused in child hood !!)....,

1. What are the compensations possible to the REALLY harassed and ARRESTED husband ??

2. What are the compensations to the 10s of 1000s of VICTIM HUSBANDS and Mothers in Law who have been wrongly named in FALSE dowry complaints ALL OVER THE COUNTRY ?

3. In the name of Womens lib, are the law makers and police CREATING a volcano, fed by the fury of irritated, mad or psychologically damaged and lying YOUNG WIVES ??

4. What are the punishments to Pooja Chauhan in this particular case such MAD women filing false cases against husband ?

5. Why is she suddenly eligible for rehabilitation, while she should have been hauled up for
(a) filing FALSE cases ?,
(b) nudity / semi in public
(c) acting against cultural ethos of our country
(d) indecently describing other women including her mother in law and sister in law
...and so on

6. What exemplary actions is the Govt taking to stem the tide of such MAD women ABJECTLY MISUSING LAW ?

7. What would have happened to this poor husband had not his community come to his support ?

Woman jumps to death from fifth floor

PUNE: A newly-married woman, Swati Rajesh Maharnoor (22) of Vallabhnagar in Pimpri, allegedly committed suicide by jumping from her fifth floor residence on Saturday morning.

Swati's father Krishna Galande (48) of Maan in Sangli, however, claimed that Swati's husband and parents-in-law harassed her for a dowry of Rs 2 lakh. The police have not found a suicide note in the house.

The police arrested Swati's husband Rajesh (25), a software engineer, her mother-in-law Madhumati and father-in-law Gangaram (54) for allegedly harassing her and abetting in the suicide.

Swati jumped from the balcony of her apartment in Sukhwani Campus, Pimpri around 10 am. She was rushed to Yashwantrao Chavan Memorial Hospital and then to a private hospital, where she died.

Swati and Rajesh got married on December 14, 2006. Rajesh works in a software company in the Hinjewadi Infotech Park.

Pooja Chauhan case: NHRC notice over delay in police action
RAJKOT, JUL 6 (PTI)

National Human Rights Commission (NHRC) has served a notice to city police commissioner for the alleged delay in police action on a dowry harassment complaint by Pooja Chauhan who had semi nude on the streets to highlight her grievance.

Police Commissioner K Nityanandam has been asked by NHRC to submit his reply within seven days, police said today.

Chauhan alleged police was delaying action against her husband and mother-in-law and she walked to the Police Commissioner's office on Tuesday in her undergarments demanding action on her complaint.

She alleged the two had repeatedly harassed her for dowry.

However, according to Gandhigram police inspector Sardarsinh Zala, the two had been arrested even before Chauhan's protest walk.

Chauhan had attempted suicide on June 29 by torching herself in the premises of local crime branch of the police but was saved, Zala said, adding police did not waste time and arrested the mother-son duo a couple of days after the suicide attempt.

He said Chauhan's mental condition was unstable and she might be sent for medical examination.

Dowry slur lands actor in custody

Bhubaneswar, July 8: Actor Chandan Kar was today arrested and forwarded to court on charges of torturing his wife for dowry.

Chandan, a software engineer working with Satyam, had married Sridevi Mishra on March 11 this year. But in less than four months' time Chandan (28) and his family allegedly started torturing the girl for dowry. Sridevi, an employee with the ICICI, was forced to leave the job after being continuously harassed reportedly by her husband and in-laws.

In her complaint to the city Mahila police station, she alleged that she was continuously pestered for more dowry. Hailing from a well-to-do- family, Sridevi had brought along goods worth Rs 10 lakh along with a plot at Bhubaneswar. "However, my in-laws kept pestering for a Honda City," she alleged.

Sridevi said that she married Chandan — whose claim to fame was last year's Babu I Love You — because his looks matched Anubhav's, said to be the numero uno of Oriya film industry .

"They started framing allegations about my affair with Anubhav," she said. She had received burn injury marks, which she alleged were caused by her husband with a hot iron rod.

"After investigation, we have arrested the accused," said Bilasini Nayak, the Mahila police station IC.

1. Was there a Hindu Marriage ?

A Hindu Marriage NEED NOT NECESSARILY be registered !

As long as the pictures (you say pictures ..correct ?) show that the essentials of a HINDU marriage are present - like Sapthapathi ... or other regional variations etc (e.g. Magalsuthra called Thali in TN etc etc ) it would be  a valid HINDU marriage

Irrespective of your OTHER marriages elsewhere, this would constitute a HINDU marriage and having been conducted IN India

Should you wish to end such a marital status, you will be subject to relevant laws of India - for e,g Hindu Marriage act - divorce or annulment proceedings


2. US Marriage or other marriages

Most probably this divorce in US MAY absolve you / terminate your US marriage - subject to laws of US

If the US divorce decree is a valid divorce u/s 13 CPC and is in accordance with Hindu Matrimonial laws, it MAY be valid in India. Read the archives here for more on validity of foreign decrees


3. 498a is another issue


4. IMHO You can be accused u / s 498a IPC as you are married IN INDIA, Under a HINDU Marriage (as per 1 above) and MAY have lived in INDIA or at least temporarily stayed in INDIA after marriage

4.1. IF you have NOT stayed EVER in India AFTER marriage, and IN THE EVENT your wife files a FALSE 498a against you, you will have to fight the case under jurisdictional issues - I am NOT very sure if this is a strong point ... but well you MAY try

ONCE a husband is READY TO LIVE with the wife AND HE is READY TO FACE legal troubles INCLUDING court cases, police action, arrest etc etc .... his position is VERY strong

This applies to a very large proportion of cases whether or NOT you have everything in writing

Just look at it from the Judge's or even the police's point of view

- As a husband, you are ready to live with your wife

- If AN un scrupulous wife files a false case you are ready to fight that

- If the police try to arrest you, you are ready to go to Jail !!

- You are NOT ready to pay the un scrupulous women i.e. NOT running away from a fight ... NOT giving up without fighting for your LEGAL rights


.......what more can they do to you ??

Rajkot, July 08: Though a special team of the Gujarat State Commission for Women (SCW) visited Rajkot on Sunday to conduct a probe into the Pooja Chauhan case, it returned back with incomplete facts.

The reason: Pooja Chauhan was not available.

The two member team comprising Balu Vaghela and Jasu Kansara left Rajkot with a one-sided story after failing to locate Pooja .

"From Pooja's parents to in-laws and the police, no one had any idea about her whereabouts . We could not get her version of the story, which is very necessary for reaching a conclusion," said Vaghela.

The delegation visited Rajkot to find out why Pooja had paraded semi-nude on the roads of Rajkot.

They met Commissioner of Police K Nityanandam to get the police's version of the story. The SCW members also talked at length with the officials of Gandhigram police station where Pooja has registered the case.

While the members found Pooja's house locked on their arrival, they met her husband Pratap and mother-in-law Hansaba.

The SCW team told mediapersons that the accused have pleaded innocence alleging that it was Pooja who had been harassing them.

"Her husband has said that Pooja used to mentally and physically torture his mother," said Kansara.

Rajkot court asks police to provide protection to Pooja Chauhan

RAJKOT: A court in Rajkot has ordered police to provide protection to Pooja Chauhan, who created a flutter by walking semi-nude on the city's streets to protest alleged harassment by her husband.

The court also said she should be allowed to continue staying in her rented accommodation. Chauhan's landlord had asked her to vacate the home after her controversial protest. The Gandhigram police station has received a copy of the order issued on Saturday by Judicial Magistrate R M Bhatt, who directed police to provide necessary protection to Chauhan.

But police said they had been unable to trace Chauhan. "After the court's order, we went to Puja's rented house in Shastrinagar but we found it locked," Inspector Sardarsinh Zala said.

The court's order directed her landlord in Shastrinagar, where Chauhan has been staying for the past year with her three-year-old daughter, not to ask her to vacate the house. The court also summoned four accused -- her husband Pratap Chauhan, mother-in-law Hansa Chauhan and two neighbours -- to appear before it on July 10.

However the four are suspected to have left the city following Chauhan's protest, Zala said.

The court's order came in response to a complaint filed by Chauhan under the Domestic Violence Act, police said.

I am saddened to hear your case. You seem to be married for four years now. Sad that a marital discord reached such a status after a few years of marriage.

Yours is NOT an isolated case. Even courts are aware of this Rampant Misuse

a.1. Quash of a FALSE 498a. Judge speaks of misuse !

Were you to spend a day at home in the exclusive company of your remote control, you might come to the conclusion that "Snapped" was the most consistently rerun show on television. A true-crime series set to begin its sixth season on the Oxygen network in the fall, "Snapped" appears every Sunday night and for hours and hours each weekday. Should you happen upon it on a random Wednesday morning, you might feasibly reorganize a closet, do some yoga in your living room, make a brisket and still never be forced to change the channel to find something new to watch.

"Snapped," which made its debut three years ago, is about women who murder. It remains among Oxygen's highest-rated shows, having had an instrumental role in recasting women's television away from its celebrations of victimhood to its new fetish for female aberrance. ("Snapped" is rivaled in popularity on Oxygen only by "The Bad Girls Club," a reality show whose title precludes the need for any explanation.)

Some of the women profiled on "Snapped" have killed abusive husbands, but for the most part they seem to kill men who get in the way of their grander ambitions. And for this reason "Snapped" has sparked controversy among feminist groups who claim it draws attention away from the issue of domestic violence, which they say is what typically prompts women to murder spouses.

"Snapped" gives us beauty queens who kill their cheating fiancés, gold diggers and black widows who drug their rich husbands to death. In one episode, a woman who had dumped her husband for his young nephew becomes the obvious suspect when both men turn up dead.

"Snapped" is a testament to the dangers of dull small-town life. Everyone seems to come from a place with a name like Wapakoneta, Ohio, where Kim Anderson was acquitted of killing her divorce-lawyer husband — he just wasn't successful enough for her, observers in the episode imply — even though she called 911 to report that she had shot him. Her lawyers argued that she acted in self-defense.

Boredom leads to carousing and generally inauspicious outcomes, we must infer. "She played around with every guy in that trailer park," it is said of Stella Nickell, a woman who was sentenced to 90 years in prison for filling an Excedrin capsule with cyanide to relieve herself of her husband, Bruce, and become eligible for $100,000 of his life insurance policy.

The circumstances confronting those featured on "Secret Lives of Women," the compelling documentary series that concludes its current season on Tuesday night on WE (Women's Entertainment), are not nearly as sticky. The series attaches a certain sense of empowerment to unconventional behavior — like infidelity — and it defies the standards of pop-cultural feminism by refusing to solicit our sympathies for women obviously in trouble.

A young woman named Irene, featured in a recent episode on obsessive-compulsive disorder, had been 200 pounds and lost 85, we are told. Still, she thought she was way too big. "I made a tape and listen to myself say, 'You're fat, you're fat, you're fat,' just nonstop," she explains. "Right now I'm 5 feet, 5 inches and weigh 115 pounds. I don't think that's acceptable. Once I hit 100, that would be perfect. That would be perfection at its finest."

Irene is thin, but she doesn't care about thinness. She is interested in living without fat. She knows that she is addicted to weight loss but she doesn't find her behavior unreasonable, and the producers level no judgment against her.

"Secret Lives of Women" has helped to popularize the term "cougars" with its installment on older women who date younger men. In an episode on cheating, a woman named Dawn, a private investigator from New Jersey, presents herself as doing the Lord's working by helping women catch their husbands in acts of adultery.

The focus of that episode, though, was on women who cheat. Some, we learn, use the Web site of the Ashley Madison Agency, developed specifically to help women in loveless marriages find men with whom they can sneak around. "I'm a marketer, an entrepreneur, probably in the true 16th-century Italian meaning of the term — identifying a need in the marketplace and not being afraid to fill it," explains Darren Morgenstern, who created the company. "I help married women have affairs."

Infidelity, in the series's view, can boost esteem. As one woman puts it, "I define cheating as something not good, that at the same time may help you go through some things that you are currently going through."

AKRON, Ohio: An American woman accused of offering her younger lover a share of her husband's multimillion-dollar estate if he would kill the 69-year-old Indian doctor was convicted of murder-for-hire and other charges.


The defense had argued that Donna Moonda's 25-year-old lover, Damian Bradford, had acted alone and that Moonda had tried to revive her doctor husband after Bradford shot him along the Ohio turnpike. Federal prosecutors said the two were in it together and portrayed Moonda as a perpetual liar, thief and drug user.


Moonda, who quietly cried when the verdict was read Friday. The 48-year-old former nurse could receive the death penalty or life in prison without parole.


Bradford, the key witness, has admitted to shooting Dr. Gulam Moonda in the side of the head on May 13, 2005, after his wife pulled over on the turnpike south of Cleveland, supposedly to let her husband take the wheel.


The jury also convicted Moonda of interstate stalking and two counts of using or carrying a firearm in the commission of a violent crime.


As U.S. District Judge David D. Dowd Jr. read the four guilty verdicts, Moonda went from holding back tears, to shaking her head to quietly sobbing, dabbing her eyes with a tissue.


Jurors deliberated about 8 hours over two days after more than two weeks of testimony.


Moonda's defense was that Bradford, a convicted drug dealer, robbed and killed the doctor in a steroid-fueled rage. Bradford met Donna Moonda in drug rehab, according to court records.


Bradford has pleaded guilty to interstate stalking and a gun charge and is expected to receive a 17 1/2-year sentence in exchange for his cooperation.


He testified that on the day of the shooting, he followed the couple as they left their home in Hermitage, Pennsylvania, near the Ohio state line and pulled in behind them when Donna Moonda stopped their Jaguar along the turnpike. He said he ran to the passenger side of the car and shot the doctor.


Other key evidence cited by prosecutors were a series of phone calls and text messages between Bradford and Moonda the day of the killing, up until she and her husband left on their trip.


The plot was set off the day of the shooting when Moonda sent him a text message that said, "I'm getting some water," Bradford testified.


Prosecutors told the jury that Moonda grew tired of marriage to the doctor more than 20 years her senior, but was still in love with his money.


"She wanted to get what was owed to her," Bradford said on the witness stand.


The defense contended that Moonda could have received $1.3 million (€960,000) to $1.5 million (€1.1 million) in a divorce settlement.

But prosecutors said she did not know that and believed she would have been limited to $250,000 (€183,877) by a prenuptial agreement. The doctor, worth more than $3 million (€2.21 million), also had life insurance policies totaling $676,000 (€497,205).


The jury of seven women and five men that convicted Moonda will return to federal court July 16 for a hearing to determine her sentence.


Donna Moonda's sisters left the courthouse without commenting. The doctor's family was not present in court for the verdict.

Rajkot, July 07: Pooja Chauhan's husband Pratap Chauhan has alleged
that his wife is an alcoholic and indulged in flesh trade.

Pratap has also alleged that Pooja was married before marrying him.

In a written statement released to the media, Pratap, a labourer from
Shantinagar slums on the 150-feet ring road, said that one Pratima
Deepak, who resides near Amrapali Cinema, is Pooja's agent. "Together
they have been running the illegal activity of prostitution, '' he
said in the statement.

Pratap, who has been summoned by the First Class Judicial Magistrate
on July 10 in connection with a case filed by Pooja alleging him of
mental and physical harassment, said that it was in fact Pooja who
had been cheating and harassing his family since their marriage in
2004.

According to him, they got married on April 3, 2004. At the time of
the marriage, she declared that she was an orphan. "But later I
discovered that her parents were alive and she was already married to
one Bhupat Gohil before marrying me,'' he said in the statement.

Pratap further said that he found her to be an alcoholic who would
often physically and mentally harass his mother Hansaba. A month
back, he had registered a complaint against Pooja in this regard at
Gandhigram Police Station.

After Pooja Chauhan's pornographic tamasha in Rajkot, Gujarat, a procession of professional idiots have risen up to assure us, the great brainless public, that despite all appearances to the contrary, Pooja Chauhan has not violated any laws of the land, and should not be investigated or prosecuted.

Indeed, under this blackmail, the woman's husband and in-laws have been summarily arrested and are being subjected to "justice" a la the Indian media's "Kangaroo Court".

And, as if this is not enough, governments are tripping all over themselves to "punish" police officers who had failed to act on Pooja Chauhan's original complaints (and presumably also reward those police officers who, stampeded by these idiots, rubbish the law in order to wrong her husband, inlaws and neighbors).

Moreover, pompous imbeciles eagerly assure us, the great brainless public, that "no woman would morally degrade herself unless pushed to extremes".

Therefore, women, cross our hearts, are incapable of moral wrongs unless really pushed hard.

Of course, the corrollary is that men have no moral compunctions worth speaking of, and will degrade themselves at the drop of the hat.

And the rights to justice and against being prejudged (whence the legal term "prejudice", that VIRTUE so wellbeloved of the Indian state and the pompous imbeciles that run the Indian state and media) of Pooja Chauhan's husband, in-laws, and now, of course, all those of her neighbors, etc., against whom she may bear whatever kind of a grudge, go out into the dustbin.

All this adds up to tell us that Justice in the India that Mohandas Karamchand Gandhi fought so hard to fashion, is not so much a jackass as much as it is a Prostitute - a Tawaif.

God help us and rescue us from the dainty delights of Indian Justice.

RAJKOT: After stripping to her inner-wear on Tuesday in full public glare, 22-year-old  Pooja Chauhan was a relatively relieved person on Friday after being assured that the police had registered her complaint and was taking adequate action.


Though they have been released on bail currently, a case has been registered under the Domestic Violence Act. But she wanted to take revenge against one neighbour Ranchod, who had allegedly abused her physically.


Asked to vacate her house by her landlord, Pooja now faces another problem - finding a shelter for herself and her two-year old daughter. However, these hardships or the media outcry and national attention do not seem to bother her at all.


She is driven by hatred and the obsession to take revenge.


"I will stay in an open plot if necessary and do whatever work is offered to me. If no one gives me a job, I will sit idly, but not go back to live with my parents," she said.  She is intent on beating up Ranchod and making him "wear bangles".


An NGO, Saurashtra Kutch Network of Violence against Women, has come to her aid to provide her shelter and other basic necessities. Coordinator of the NGO Dheeraj Derwaria said they are willing to provide her a home and justice under the Domestic Violence Act. The home will be provided only after three months.


Meanwhile, Centre has set up an inquiry committee to look into the allegations of police inaction forcing a woman to walk semi-nude to highlight her harassment for dowry. The four-member committee will be headed by Malini Bhattacharya, also a member of National Commission for Women (NCW).

Chennai, July. 4 (PTI): Popular actor T Prashanth today filed a petition before a family Court, seeking to declare his marriage with Grahalakshmi null and void, and to grant custody of his son to him.


Prashanth appeared in person and filed the petition.


Prashanth had filed a petition earlier seeking restitution of conjugal rights. Though initially Grahalakshmi objected to this and claimed Rs one lakh per month as interim compensation, she subsequently expressed her willingness to join with him.


Two conciliation meetings were held by the Family Court.


During the process, Grahalakshmi lodged a complaint before the Commissioner of Police, alleging dowry harassment. Following this, Prashanth filed anticipatory bail petition. While granting anticipatory bail, a sessions court observed that since both parties expressed their willingness to 're-join,'it could be better if they appear before the family court on June 18 and settle the issue.


Prashanth then lodged a complaint before the police, alleging that Grahalakshmi was already married and that she had suppressed the fact and married himn.


He also filed a petition before the family court, seeking permission to withdraw his petition seeking restitution of conjugal rights.


He withdrew the petition yesterday after the permission was granted.

Actor Srikanth admits to marriage with Vandana

 
Chennai, July 7: Popular Kollywood actor Srikanth, who has been embroiled in a legal battle over his wedding to an industrialist's daughter Vandana, today admitted that he had married her.

''However, I would have to think before uniting with her,'' he told reporters outside Vadapalani Police station where he came to sign the register as per the court order.

''I admit that I married Vandana. However, several cheating cases against her family forced my parents to halt plans for a grand wedding,'' he added.

Earlier, the actor and his parents appeared before the Vadapalani police and signed the register.

Srikanth and his parents had obtained anticipatory bail in a case filed by Vandana against him, stating that she had married him on February 7 in Kakinada and produced the wedding photographs.

She had also filed a police complaint, seeking their help to get united with Srikanth. The court had ordered them to appear before the Inspector of Vadapalani police station and sign the register.

The actor's proposed formal wedding with Vandana was put off following a spate of cheating cases filed against her family.

However, Vandana was forcibly staying in Srikanth's house since a few weeks ago.

Meanwhile, Srikanth filed a petition in the family court, seeking divorce from Vandana, claiming that she had trespassed into his house and that she was trying to tarnish his image in the film industry.

Centre sets up inquiry committee to probe Rajkot incident

NEW DELHI: The Centre on Friday, set up an inquiry committee to look into allegations of police inaction forcing a woman to walk semi-nude on the streets of Rajkot to highlight her harassment for dowry.

The four-member committee headed by Malini Bhattacharya, also a member of National Commission for Women (NCW), would inquire into the circumstances that compelled the victim to take such a step, according to a senior official in the Ministry of Women and Child Development (WCD).

It would also inquire into the steps taken by the police in dealing with the complaint of "dowry demand and harassment" lodged by the victim and the reasons for "inaction".

The committee would investigate into the case and submit a report to the NCW within ten days. Its will give its recommendations to the Commission for taking action as deemed fit against the culprits.

The committee would visit the areas involved, meet the victim, public officials and others.

It would also recommend remedial measures and strategies to punish and prevent recurrence of such incidents.

The panel also includes NCW Law Officer Yogesh Mehta, Under Secretary in the WCD Ministry Nandan Singh and Vice Chairperson of National Institute of Public Cooperation and Child Development (NIPCID) Alka Lamba.

Pooja Chauhan, 22, had walked on the roads of Rajkot in a semi-nude condition to protest against alleged harassment by her in-laws for not bringing sufficient dowry and bearing a girl child after police reportedly did not act on her complaint.

6. FURTHER The supreme court has laid down many rules on arrest. God knows as to how many are followed in case of arrest of ORDINARY people !!

7. I am repeating the Supreme court directives here for public reading





The Supreme Court has observed in several decisions that these rights are to be recognised and scrupulously protected.    These rights are:-

-     Police personnel carrying out the arrest and handling the interrogation of the arrestee should bear accurate, visible and clear identification and name tags with their designations.  The particulars of all such police personnel who handle interrogation of the arrestee must be recorded in a register.

-     That the police officer carrying out the arrest shall prepare a memo of arrest at the time of arrest and such memo shall be attested by at least one witness, who may either be a member of the family of the arrestee or a respectable person of the locality from where the arrest is made.  It shall also be countersigned by the arrestee and shall contain the time and date of arrest.

-     A person who has been arrested or detained and is being held in custody in a police station or interrogation centre or other lock-up, shall be entitled to have one friend or relative or other person known to him or having interest in his welfare being informed, as soon as practicable, that he has been arrested and is being detained at the particular place, unless the attesting witness of the memo of arrest is himself such a friend or a relative of the arrestee.

-     The time, place of arrest and venue of custody of an arrestee must be notified by the police where the next friend or relative of the arrestee lives outside the district or town through the Legal Aid Organisation in the District and the police station of the area concerned telegraphically within a period of 8  to 12 hours after the arrest.

-     The person arrested must be made aware of his right to have someone informed of his arrest or detention as soon as he is put under arrest or is detained.

-     As entry must be made in the diary at the place of detention regarding the arrest of the person which shall also disclose the name of the next friend of the person who has been informed of the arrest and the names and particulars of the police officials in whose custody the arrestee is.

-     The arrestee should, where he so requests, be also examined at the time of his arrest and major and minor injuries, if any present of his/her body, must be recorded at that time.  The "Inspection Memo" must be signed both by the arrestee and the police officer effecting the arrest and its copy provided to the arrestee.

-     The arrestee should be subjected to medical examination by a trained doctor every 48 hours during his detention in custody by a doctor on the panel of approved doctors appointed by Director, Health Services should prepare such a panel for all Tahsils and districts as well.

-     Copies of all the documents including the memo of arrest, referred to above, should be sent to the jurisdictional Magistrate for his record.

-     The arrestee may be permitted to meet his lawyer during interrogation, though not throughout the interrogation.

-     A police control room should be provided at all district and State headquarters, where information regarding the arrest and the place of custody of the arrestee shall be communicated by the officer causing the arrest, within 12 hours of effecting the arrest and the police control room it should be displayed on a conspicuous notice board.

Govt inquiry into mad woman's semi-nude protest ! what a waste of public money

This really takes the cake. The govt. is now setting up an inquiry into the incident where a mentally disturbed woman walked semi nude thru Rajkot's streets

Why is this bias FOR women ? that too URBAN woman ? there are millions of homeless men, who work with JUST their loin cloth on ? There are 10s of 1000s of women in brothels selling their bodies for sex. Red light areas abound all over the world, where sex is peddled. Which Government inquires into those cases ? why is this particular lunatic woman from Rajkot taken so seriously ??

Is this something deep down in our psychology ? does NUDITY /
semi - nudity tickle us ? does NUDITY / semi - NUDITY catch us off guard ? are we still mentally peeping at these NUDE pictures ? are we as a society all obsessed by the female body ? and exposure ? or is this because a WIFE walked semi - nude ?? a mother a married woman WALKED semi - NUDE and that too in public ? Will the same response bee seen if a man ... a husband walked nude  / semi - nude ?

Govt inquiry into semi-nude protest

The Gujarat government has set up an inquiry into the incident of a woman walking semi-nude on the streets of Rajkot to protest alleged dowry harassment.

On Wednesday Pooja Chauhan stripped down to her underclothes and walked on the roads for an hour to protest against alleged harassment by her husband and in-laws.

Pooja said her husband, his family and the apathy of the Rajkot police pushed her to the extreme by severe mental and physical abuse.

The police reacted immediately by arresting her husband and three others.

BHUBANESWAR: Everyday, more than one woman are either killed or commit suicide for dowry in Orissa.

According to a White Paper circulated in the Assembly by the Home Department, as many as 570 cases of murder and suicide by women relating to dowry had been recorded in the State during 2006, with most deaths occurring in the developed coastal plains.

A total of 531 murders linked to dowry were reported during the past year while 39 women committed suicide during the same period.

This showed a rise in dowry death cases compared to 2005 when 458 murders and 26 suicides were recorded, it said.

The White Paper said chargesheets had been filed in 299 dowry murder cases while another 224 cases were being investigated. In eight cases, the allegations were found to be untrue.

Chargesheets had also been filed in 20 cases of dowry related suicides while investigation is in progress in 18 cases. One case was found to be untrue.

Besides, 1,702 cases of dowry related torture had been registered in the State during 2006 and chargesheets had been filed in 799 of them.

Dowry-related murders, suicides and torture were mostly reported from the developed coastal belt where the education level is high. Balasore district topped the list with 53 dowry-related murders, followed by Cuttack (49), Bhadrak (43), Kendrapara (36), Khurda (35), Puri (30) and Jajpur (29).

The lowest number of dowry related murders was recorded in the backward districts of Kandhamal and Deogarh (three each), followed by Jharsuguda and Gajapati (four each), Nabarangpur (five), Nuapada (six) and Rayagada and Sambalpur (seven each).

The woman who walked semi-nude on Rajkot roads on Tuesday evening will undergo medical examination. The police believe that 21-year-old Pooja Chauhan took the shocking step as she was mentally unsound, which might have been due to harassment at her husband's place.

"She appears to be mentally unsound. The police will initiate the procedure for her medical examination,'' said Gandhigram Police Inspector Sardarsinh Jhala.
 
Pooja stripped up to her inner clothes on Race Course road and Yagnik Road to protest against the alleged harassment by her husband and in-laws _ and also police inaction. With a baseball bat in hand, she also took a round of the Police Commissioner's office.

She said she wanted people and police to take notice of her harassment by husband Pratap and in-laws.

The police, however, said that Pratap and his father Rupsinh and his sister Hansa had been arrested on Tuesday morning, 10 hours before Pooja staged the drama. Said Commissioner of Police K Nityanandam: "Arrest was made much before the incident in the evening.''

Pooja's mother Devuben said her daughter might be mentally upset because of the harassment. "She had been complaining about mental and physical harassment. She had a love marriage with Pratap four years back and the couple have a three-year-old girl child,'' said Devuben.On Tuesday, the police handed Pooja over to her parents residing in Laxminagar after she refused to stay at Kanta Stri Vikas Gruh, a home for unsupported women.

Nityanandam said that the police met Pooja's parents, who expressed concern over her mental condition.

"But when Pooja herself refused to saty at Kanta Stri Vikas Gruh, the police gave her custody to the parents,'' he said. But on Thursday, Pooja along with her daughter moved out of her parents' home.

"I don't know where she has gone,'' said Devuben. She was also not found at her Shastrinagar residence, where she had been living with her daughter for past 12 months.

On Tuesday evening while walking on the streets, Pooja kept on saying: "My in-laws want to marry off their son with someone else. That is why they are harassing me.'' She also publicly abused the police for ''doing nothing''.

This was the second time that Pooja tried to catch the public attention. Two days prior to that, she poured kerosene on her body and came to the crime branch to make complaints against her in-laws.

Court ordered payout 30 years after divorce to a cheating wife !!



Dennis North gets married and has three kids. His wife cheats on him and they get divorced. Dennis buys her a house and investments as part of the divorce settlement, and raises the three kids himself. Later, he pays her more money, even though she refuses to work. She squanders the money he gave her, and now, 30 years later, guess what? He has to pay her all over again
because she's "fallen on hard times." Nice.

A wealthy retired builder was ordered to pay more money to the woman he divorced nearly 30 years ago after a judge heard she had "fallen on hard times", the Court of Appeal was told yesterday.


Dennis North, 70, was divorced from his first wife Jean, 61, in 1978 - a year after finding out she was having an affair with the man she later went to live with.


In 1981, he made a financial settlement with the woman he married in 1964, buying her a house and investments.


Over the years, he increased her assets so that she would have been able to live comfortably for the rest of her life, the judges were told.


But in 1999, she sold up and moved to Australia where she saw her capital dwindle because of bad investments and what the court was told was a lifestyle beyond her means.


A district judge awarded her a lump sum of £202,000 in April last year despite agreeing that Mrs North's money troubles had nothing to do with her former husband and he had no further responsibility towards her.


Since his divorce from his first wife, Mr North had prospered and his wealth is now estimated at between £5 million and £11 million, the court was told.


Mr North, who was left to bring up the three children of the marriage and has two children by his second wife, wants the Court of Appeal to quash the award.


Philip Moor QC, representing him, told the panel of judges headed by Lord Justice Thorpe that Mrs North had made no attempt to find a job since 1977, when she was 32.


When she sold all her assets and emigrated, she chose to live in an expensive part of Sydney, he said.


If she had stayed in the North of England she would have been comfortably off for the rest of her life.


"The whole purpose of divorce is to disentangle people so they can lead independent lives," he told the three judges.


Mr Moor told Lord Justice Thorpe, sitting with Lord Justice May and Mr Justice Bennett, that it was not his client's fault that his first wife "has fallen on hard times and she cannot now go back for a second bite of the cherry".


But Mrs North's counsel, Deborah Bangay QC, said it was not her client's fault that her investments had gone wrong and the District Judge took account of her ex-husband's wealth and the fact that she needed additional support when he gave her an award at the "bottom end of the spectrum".


She added: "This was not a second bite at the cherry, but it is what are her reasonable needs. The court was entitled to take into account the obvious wealth of her former husband. It was an extraordinarily modest award set against his wealth."


The court reserved its judgment to a date to be fixed.

Father and son arrested for dowry


DURGAPUR, July 4 :

Mr Ashoke Kumar Dhar, mine custodian agent with ECL's Madhusudanpur colliery and his son, Arup Dhar, were arrested by Rajarhat PS, today on charges of torturing Arup's wife Navratna.

The woman had lodged a complaint with the Rajarhat PS a few days ago. Mr MK Manna, investigating officer with Rajarhat PS, said that the couple was married for more than four years and Arup had left for USA to resume his services after marriage.

Navratna had complained that Arup and his family were regularly pressurising her for dowry. Police arrested the culprits under sections 498(A) and 406 of IPC. n SNS

RAJKOT: Conservative Rajkot went into convulsions on Wednesday when alleged mental and physical abuse by her husband's family drove a 22-year-old woman to strip to her underwear and walk through the city in protest.

Pooja Chauhan said she had taken to this unique protest after being constantly harassed for not bringing dowry and bearing a girl-child.

The effect was immediate. The police arrested her husband Pratapsinh Chauhan, parents-in-law and neighbours Veji Bharwad and Vinu Dalit on Wednesday, after she threatened to scale up her protest and march nude to the police commissioner's office if she did not get justice.

"The arrests were made on the basis of Pooja Chauhan's complaint. We are also planning to take action against Pooja for indecent behaviour in a public place. However, we will examine her mental condition before taking any action," said Rajkot police commissioner K Nityanandam.

Residents in the busy thoroughfares of Race Course Road and Yagnik Road were left gaping in shock on Tuesday evening as Pooja walked in her inner-wear, wielding a baseball bat and bangles, headed for the police commissioner's office.

She walked for about an hour and went home later as the police commissioner was out of station.

Police sources said Pooja had a love marriage with Pratapsinh, a resident of Gandhigram area, about three years ago, but her in-laws kept harassing her for dowry. The harassment increased when she gave birth to a daughter eight months ago. She finally left home five months ago and has been living on her own with her daughter, Anjali.

Sources said police inaction on her complaints had driven her to stage such a protest. "When her complaint against her in-laws failed to evoke any response, she tried to immolate herself at the office of the police commissioner last Friday but police personnel stopped her," said a source in the commissionerate.

Supreme Court's deathly failure and death of law - I

        The common millions of India are shell-shocked by the judgement delivered yesterday by the Bench comprising Justices Tarun Chatterji and P K Balasubramanian of the Supreme Court of India on the Public Interest Litigation (PIL) filed by Manohar Lal Sharma, seeking cancellation of the nomination papers of UPA Presidential candidate Pratibha Patil. While dismissing the PIL, the Supreme Court seems to have lost sight of the fundamental issue of whether a person with incriminating and criminal antecedents like Pratibha Patil should at all be permitted to occupy the highest Constitutional Office of the President of India. The common man in the street is of the view that the Supreme Court of India has only played the role of a transit post office by 'Giving Liberty to the petitioner Manohar Lal Sharma to approach the appropriate authorities for redressal of his grievances.'


        In these columns yesterday, I had observed that the besieged millions of India are solidly supporting the PIL filed by Manohar Lal Sharma and the sacred cause of the imperative national public need for preventing the disaster of our having a President with such dubious credentials/ antecedents as Pratibha Patil. I am now pained to note that Manohar Lal Sharma has been artificially propped up by the supporters of Pratibha Patil to get a 'planned ruling' from the Supreme Court in her favour, thus perverting, subverting and prostituting the Due Process of Law.


        The Writ Petition filed by Manohar Lal Sharma, advocate in the Supreme Court of India challenging the nomination of Prathibha Patil for the Presidential Election, which was dismissed by the Hon'ble Supreme Court yesterday, does not seem to be a true Public Interest Litigation (PIL) because the crucial question as regards prevention of criminalisation of politics by political parties controlling sizeable chunks of the Electoral College through their members in Parliament and Legislatures was not properly represented by the writ petitioner. The question posed to the Hon'ble Supreme Court ought to have been this simple one: QUE CUSTODIET EST IPSOS CUSTODIOS? Who guards the Guardsman? Such a question was not raised before the Hon'ble Court, which dismissed the writ petition, based on earlier decisions of the Apex Court in Khare's case vide AIR 1957 S.C. 404, Babu Rao Patel's case vide AIR 1968 S.C. 904 and S.K. Singh vs. V.V. Giri vide AIR 1970 S.C. 2097, wherein it was held that disputes arising out of or in connection with the Presidential or Vice-Presidential Election should be decided by the Apex Court ex post facto to such election. All these decisions pertain to the Presidential and Vice-Presidential election procedure which is regulated and governed by the Presidential and Vice-Presidential Elections Act 1952 (Central Act 31 of 1952) which is silent on prevention of criminalisation of politics. In Mohini Jain and Unni Krishnan cases the Apex Court held that where a vacuum is created by a legislation being silent on some crucial aspects, the Apex Court has to fill in such gap by formulating suitable guide lines which operate as law until Parliament enacts a law on the lines of such guide lines. Under Art.71 clause (1) of the Constitution it is the Supreme Court's sovereign and supreme duty to do so. This deathly failure to do so has resulted in the denial and death of Law, Equity and Natural Justice.


        It is now common knowledge that the writ petition filed by Manohar Lal Sharma was apparently masterminded by a pro-Prathibha Patil group, with the fond hope of creating an estoppel or res judicata to thwart any proper and legally sustainable PIL writ petition that may be filed in the future, just in order to ensure the immediate smooth passage of otherwise impeachable Pratibha Patil's progress on her road to the Presidency. The Congress Political Goons and Criminals seem to have lost sight of the fact that is no estoppel or res judicata in PIL writ arena as there can be no estoppel against the Indian Constitution.


        The great Justice Oliver Wendell Holmes (1841-1935) has observed that since the best part of his life was spent as part of Judiciary, he would have been less than fair to himself not to seek to critique and correct that institution when he notices something going wrong. Judge Jerome Frank has rejected the suggestion that 'In a democracy it can ever be unwise to acquaint the public with the truth about the shortcomings of our Judiciary.' The judiciary is not the least dangerous branch of Government. They send people to prison and decide with important consequence. Because the judiciary has such a central role in the government of society we should (in the words of Justice Oliver Wendell Holmes) wash - with cynical acid this aspect of public life. Unless and until we treat Judges as fallible human beings whose official conduct is subject to the same critical analysis as that of other organs of government, Judges will remain members of a Priesthood who have great powers over the rest of the community, but who are otherwise isolated from them.'


        Justice V R Krishna Iyer quotes the following words of Felix Frankfurter, a great Judge of the US Supreme Court, with great relish, enthusiasm and approval: 'Judges commonly are elderly men, and are more likely to hate at sight any analysis to which they are not accustomed, and which disturbs repose of mind, than to fall with novelties. Judges as persons or Courts as institutions are entitled to no greater immunity from criticism than other persons or institutions. Just because the holders of Judicial Office are identified with the interests of Justice, they may forget their common human frailties.'


        I am quoting these judicial authorities only to highlight and to make it known to the larger innocent public of India that the two learned judges of the Supreme Court who dismissed a PIL on flimsy technical grounds have failed to discharge the constitutional duties cast upon them under Article 71 clause (1) of the Indian Constitution. Article 71 clause (1) states: 'All doubts and disputes arising out of or in connection with the election of a President or Vice-President shall be enquired into and decided by the Supreme Court whose decision shall be final.' Here doubts have been raised about the credentials and antecedents (not civil if not criminal!!) of Pratibha Patil.


        The Judges who sat in the Bench of the Supreme Court of India in the case in question, would not have been totally unaware of the agitated and disturbed public feelings and sentiments against the candidature of Pratibha Patil and the criminal antecedents of the close members of her family, particularly in the light of the wide spread media exposure of the deeds/ misdeeds of Pratibha Patil and her allies during the last 25 years in several walks of public life and welfare in Maharashtra. Sterile and stale technicalities apart, it is the Supreme and fundamental duty of the Supreme Court to understand the paramount national need to prevent the criminalisation of Indian politics in our Constitutional democracy, with respect to the Presidential Election 2007, more particularly in view of the facts and circumstances of the case brought out by eminent journalists like Arun Shourie, Dr. Nalapat, Sandhya Jain etc. pointing to the probable/ possible complicity of Pratibha Patil in various serious offences including shielding of conspiracy to murder.


Perhaps the two eminent Judges are unaware of the following words of Justice Cardozo: 'The great tides and currents which engulf the rest of men, do not turn aside in their course and pass the Judges by.' By dismissing the PIL petition of Manohar Lal Sharma, as though it related to a small and petty civil dispute of no significance to the nation, the learned Judges of the Supreme Court have allowed the common people of India to be beached by the rising tide of criminal Congress history. All the leading pillars of the collapsing Ship of Indian State � The Executive, The Legislature and The Judiciary � seem to be participating with great gusto and enthusiasm in this tidal process of criminalisation of Indian politics and public life.

VISAKHAPATNAM: In a curious twist to the tale, Renu Desai, who reportedly married actor Pavan Kalyan without the latter giving divorce to Nandini, stated in a reply to legal notices that she did not marry Pavan Kalyan at all.

Renu Desai's reply came to light in the course of investigation on Tuesday and petitioner Nandini's legal counsel is learnt to be exploring various options to make the actor depose before the judge.

"It is a fact that the actress had responded to notices received by her on May 5, and has said in the counter that she did not marry Pavan Kalyan and she was implicated in the case without any involvement in the case," Nandini's advocate B Satyanarayana told this website's newspaper.

Satyanarayana said Renu Desai had sent the reply on May 18 through her advocate in Hyderabad and it contained an address in Pune, suggesting that she was not with Pavan Kalyan.

Much before the filing of a bigamy case by Nandini before the First Additional Chief Metropolitan Magistrate recently, several notices were sent to Pavan Kalyan and Renu Desai to undo the injustice done to Nandini.

It was after the defendants gave unsatisfactory replies that the bigamy case was filed before the metropolitan magistrate.

A dowry harassment case under Sec. 498(A) was filed subsequently against the entire family of Pavan Kalyan, including his actor brother Chiranjeevi.

Claiming to be the wife of Pavan Kalyan, Nandini contended that he married Renu Desai without divorcing her and sought a monthly alimony of Rs 5 lakh.

KOLKATA: In a scene straight out of a Bollywood potboiler, a man fired at his brother-in-law after an altercation over the custody of his child on Sunday at BNR North Colony in the West Port area.

Nageshwar Rao, a resident of the colony, was attacked by his late sister's husband Sudama Singh after he refused to hand over his son, whom Singh had dumped along with the child's mother two and a half years ago, police said.

Nageshwar's sister Rina had came back from her husband's Asansol home with her son about two and a half years ago. She was ill then and succumbed to her illness in February 2007, leaving behind Debu, who was then two years old. Nageswar has been looking after Debu since then. "Sudama didn't even attend the funeral of his wife. He asked us to send her body to Asansol," Nageswar, a private firm employee, alleged.

On Sunday afternoon, an altercation broke out after Sudama suddenly appeared at Rao's home with three others and demanded to take back his son Debu. Sudama fired at Rao after he refused to hand over Debu, but luckily the bullet miss its target. The accused then hit Rao on the head with the butt of the revolver.

After Rao's wife raised an alarm the assailants fled. But local residents gave them chase and nabbed his three companions while Singh managed to escape. They were handed over to the West Port police and were identified as Upendra Rai, Babu Thakur and Shovan Singh. Shovan is the younger brother of Sudama.

Probe revealed that Sudama works as a porter in Asansol and and the other three are his friends. Sudama had arrived in the city a few days back and was threatening Rao over phone. Police have initiated a case of attempt to murder and are looking for Sudama.

MUMBAI: "What is so immensely wrong if a mother of two daughters wants to have a male child?" Chief justice Swatanter Kumar of the Bombay High Court on Monday asked the Union government's advocate.

The Chief Justice made this observation while he and Justice Ranjana Desai were hearing a public interest litigation (PIL) filed by a couple who have challenged the legality of the ban on pre-natal sex determination tests. The Chief Justice also emphasised in the same breath that "no country could imagine a society without women."

The Bench which concluded the hearing on the PIL has reserved its judgment. In 2005, a similar petition by a Borivli-based couple had been dismissed by the HC, but by a different bench.

The present PIL was filed by a Mumbai-couple Vijay and Kirti Sharma who have two daughters and want a son.

Challenging the legal validity of the Pre-Natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 2002, the couple claimed that the law was discriminatory and violated their fundamental right. The couple's lawyer also contended that many countries permitted sex determination of the foetus and many couples from India were travelling overseas to undertake the tests.

A campaign urging more women to become firefighters has been launched with the message: "To be part of our team you don't have to be one of the boys."

Adverts show women with make-up on the top half of their faces and the other half covered in black soot, while the headline reads: "One of the girls".

The service said it wanted to emphasise the shift away from the "traditional and stereotypical firefighter image."

In Wales, 2% of firefighters and 3% of their retained colleagues are women.

The three Welsh fire and rescue services have joined forces with the assembly government for the campaign.

Posters, which will be seen in places such as gyms, leisure centres and shops, feature four female firefighters from across Wales.

A hotline for women interested in getting more information about a career as a firefighter has also been set up.

Claire Morgans, of South Wales Fire and Rescue Service, said this was the first time all in Wales had come together to raise awareness among women that a career with them is not "out of their grasp".

"The reason we want to get women firefighters in is to challenge the stereotypical images of firefighters being big and butch and white and male," she said.

Women can bring many skills to the role, she said, such as communication which is vital to be able to carry out the educational aspect of the job today.

She said: "Obviously women still need to have physical strength and stamina.

"To educate and communicate is just as important as the actual physical skills firefighters need.

FEMALE FIREFIGHTERS

The shift pattern of retained firefighters, she said, could be particularly suitable for women who can fit it around their work or children.

Brian Fraser, chief fire officer of the South Wales Fire and Rescue Service, said all the Welsh services were committed to equal opportunities.

"Our firefighters come in all shapes and sizes and from all walks of life.

"The fire and rescue service is a truly community-based organisation, so it's important that the employees of the service should reflect the communities we serve" he said.

Social Justice and Public Service Delivery Minister Andrew Davies said: "The fire and rescue services play a crucial role in the safety and security of Wales and it is vital they have the right mixture of talent to meet the evolving needs of the 21st Century."

HYDERABAD: 'Ladies nights' where drinks are on-the-house no longer attract them. Instead of heading for the happening pubs in the city, they prefer chilling out at local watering holes — the bars.

Several working women and students who down a peg or two have made bars open doors for them. The women either share space with other customers or head towards the exclusive seating arrangement meant for them in the bars. In at least 10-15 bars located in the city and its surrounding areas, women are now regular customers. These places turn out to be affordable and comfortable places for the bacchanalian gatherings of women.

This new trend could be termed by many as 'stepping across the line' or 'pushing at the limits' but for many women in the city, drinking in a bar is nothing more than a natural and normal thing to do. "Like any other public space we have a right over this one as well," said Aparna Nandakumar, assistant editor of a publishing house.

"Why should we mind women customers? All we want is good business, be it men or women," says Ravi, cashier of Nikita Bar, Mehdipatanam. Nikita Bar is frequented by at least 15 women who go there for a drink.

Many of these women also have a valid reason to prefer small bars to pubs: "Pubs charge too much. And I am not very comfortable in company that feels self-important and shows off," said Anwesha Chakravarthy. In most of the pubs in the city, a couple of beers and a pack of cigarettes cost above Rs 1000 while the same would be around Rs 150 at any local bar. The casual mood, which they prefer, is maintained at the bars as well.

Would travelling home after a drink be a problem? "We are not drunkards. We only drink and know our limits and can get home safely," says Meghna Rao, a freelance photographer and writer.

Also, they keep a distance from bars where men still think such places are their territory. "A friend had a bad experience in a bar where she was literally threatened by a man who used filthy language. We stopped going there," Aparna said.

Though many bars have a common floor for all customers, in order to avoid undesirable incidents many provide separate chambers and exclusive waiters for women. To ensure their own security, many women visit bars in groups of three and more.

Shalini Annie, research scholar, University of Hyderabad who occasionally drops by at a bar, says if she is in the company of other girls, she gets 'to claim a little more of the male dominated space.'

"To be able to do something like this there needs to be a certain level of recklessness. Perhaps one which sets you free from societal pressures," said Aparna.

Catholics roll out marriage campaign

DENVER -- U.S. Roman Catholic bishops have begun a campaign to strengthen the institution of marriage by encouraging spouses to perform simple day-to-day gestures for each other.

The campaign, a series of radio and television spots, is part of a broader effort to bring a greater Catholic voice to the debate over the meaning of marriage.

The spots show ordinary people in parks and other public places answering the question "What have you done for your marriage today?" The answers -- waking up early with the baby, organizing a date night -- are meant to promote small acts of kindness as medicine for making marriages last a lifetime.

Missing from the spots is any overt religious message, although they are identified as Catholic and end with an invitation to visit www.foryour marriage.org. The Web site promises resources for Catholic and non-Catholic couples on issues as diverse as conflict resolution and finances.

Denver Archbishop Charles Chaput, a member of the bishops' committee on marriage and family life, said the spots deliberately avoid religion to reach a wide audience.

"Both marriage and family are necessary for the common good of society," he said. "When either institution weakens, all of us suffer the consequences."

The $600,000 marketing campaign was introduced in Denver to coincide with the National Association of Catholic Family Life Ministers conference.

The media spots are not paid advertisements, but public service announcements available to TV, radio and cable outlet

A contempt of court petition has been filed against Delhi University (DU) and Symbiosis University, Pune for making admissions by providing reservation to OBCs in violation of the Supreme court order not to give reservation to OBCs in admission this year.The contempt of court petition by anti-reservation organisation,"Youth for Equality", which is spearheading the campaign against caste based reservation in centrally run educational institutions of higher learning, has contended that Delhi University admission form contains column providing for quota to OBCs while Symbiosis has decided to implement the 27% quota for OBCs in a phased manner by providing 7% reservation during the current academic session that is 2007-08.

According to the petition, the two institutions are guilty of deliberate and willful disobedience of orders of this court which had restrained the government and educational institutions against implementing the government notification issued in January this year providing 27% reservation for OBCs in educational institutions of advanced studies like IIM, IITs and Postgraduate medical science courses.

The petitioner has prayed to the court to summon the authorities responsible for intentionally violating the orders of this court.

A bench comprising Justices Arijit Basayat and Lokeshwar Singh Panta had stayed the government notification for one year on the grounds that the government notification is based on the data of 1931 census which cannot be authentic.

The petitions, both for and against the reservation have already been referred to a five-judge constitution bench for disposal. The petitioner opposing reservation are also seeking the review of the Manadal Comission report according to which OBCs constitute 52% of the total population of the country and this is based on 1931 census which was only caste based census and which is now over 75 years old and cannot be the current reservation policy of the State and the reservation policy should be based on economic Backwardness irrespective of caste.

The Centre is backing the caste based reservation policy on the grounds that the caste in most of the cases is responsible for social, educational and economic bakwardness of backward classes and the present government policy is affirmative and positive action by the state for upliftment of the backward caste and classes.

The Supreme Court, however, made it clear that it has nothing to do with the 22.5% reservation being provided to SC/STs.

Maputo - Alcohol abuse and infidelity have been blamed for the increase in spousal violence against Mozambican men in 2006, a recent report has revealed.

The report of the national office against domestic violence said that 767 men sought help from it in 2006, an increase of 57 cases over the previous year.

Maria Supinha, co-ordinator of the office, said excessive consumption of alcohol and marital infidelity were the main causes of domestic violence cases registered throughout the country.

She said most cases were not made public.

"A lot of men prefer to suffer in silence or have their cases solved among family structures. But they forget that domestic violence is a crime that should be denounced," said Supinha.

(July 1, 2007) — ALBANY — Buffalo attorney Patrick O'Reilly could easily spend five or six hours (at $300 an hour) preparing for a deposition in a divorce case with accusations of cheating, then grilling the husband or wife about every detail of the couple's sex life.


The marriage ultimately would be dissolved, but it could be some $20,000 or $25,000 later — per spouse. The high cost and grueling trials in which one spouse tries to prove fault will continue — unnecessarily, some believe — because state lawmakers did not vote on establishing no-fault divorce this session.


"When there's no adultery, but you have a dead marriage, and even when people recognize that it's a dead marriage and they both want out (quickly), one of them ends up having to testify" against the other, said O'Reilly, chairman of the state Bar Association's Family Law Section.


New York is the only state where a divorce is granted only if there is a legal finding of fault or if spouses both agree on a separation agreement and live apart for a year or more (known as conversion divorce). For couples who go the fault route, many times claims are exaggerated, or spouses who don't want to wait long for a divorce agree (with a wink and a nod) that one will make claims sufficient enough to establish fault, according to experts.

A panel studying the issue recommended a year ago that the state pass a no-fault divorce law, with the stipulation that all economic issues would have to be resolved before granting a divorce.


"By enacting a no-fault statute, New York law would be consistent with that of virtually every other state in allowing a marriage to be dissolved without a lengthy wait or requiring one party to cast blame upon the other," the report said.


Legislation to reduce the separation period to three months — a step toward no-fault — passed the Assembly 88-53 June 6 but languished in the Senate, where it was "not a burning issue for anybody," said Sen. John DeFrancisco, R-Syracuse, its sponsor. Bills to allow no-fault divorce based on "irreconcilable differences" died in legislative committees.


Assemblywoman Sandra Galef, D-Ossining, Westchester County, said she co-sponsored the bill because it makes sense to end an unworkable marriage as soon as possible. In the end, there is less animosity, she said.


The New York State Catholic Conference was against the three-month bill, as was Concerned Women for America, a conservative religious group.

"Marriage is not a disposable commodity; it is a public legal commitment, a powerful protector of children and a blessed sacrament to many people of faith," the Catholic Conference wrote.

New DELHI: Within days of the Supreme Court ruling that CBI should not be asked by courts to probe petty cases, a man has moved the apex court challenging an order of Uttarakhand High Court asking the agency to probe his income antecedents in a case relating to divorce proceedings.

The HC on May 8 took into account the wife's allegation that her husband had not disclosed his income faithfully before the trial court while getting a divorce decree.

Taking note of her allegations, the HC asked CBI, Dehra Dun, to probe the assets and alleged underhand dealings of the man and to proceed against him if a case is made out.

When the CBI submitted that the dispute was private in nature and the agency did not have jurisdiction to look into such matters, the HC asked it to show cause why contempt proceedings be not drawn against the SP and DSP of CBI at Dehra Dun for non-compliance of its orders. The two officers on June 11 sought time from the HC to comply with the order.

In furtherance of the HC order, the CBI hurriedly registered a PE against the husband, Sudhir Kumar Goyal, and started investigating his assets and income. Goyal, who had got a divorce decree in August 2005 from a Dehra Dun family court, rushed to the Supreme Court and filed a petition through advocate Ashok Mathur challenging the HC order asking the CBI to probe a matrimonial dispute.

While the husband accused her of intemperate behaviour causing immense mental trauma, the wife Sunita Goyal charged him with harassing her since her marriage in 1983 for insufficient dowry. In a recent case, the Supreme Court had frowned upon the order of another HC ordering CBI inquiry into the alleged kidnapping of a girl.

It had reminded that the police should be allowed to maintain law and order and the CBI should be kept free to probe complex and inter-state cases.

Ten-year-old Harmeher Singh can't figure out what's wrong — his father is under arrest and his mother has just survived a suicide attempt

Little Harmeher Singh's innocent face doesn't give away the turmoil in his mind. His father Gurpreet Singh Mago, an automobile spare parts dealer at Opera House, is under arrest on charges of cruelty levelled by his mother Amita Kaur, who is just out of hospital, having survived a suicide attempt. The Magos have had fights since December last year, when they moved into their duplex penthouse apartment at Simran Building, 15 Road, Khar. Caught between loveless parents, Harmeher and his siblings — four-year-old brother Sumeher and 11-month-old sister Meher — have had to shift to their uncle Amarjeet Singh Mago's place at Khar since the latest episode of trouble erupted.

THURSDAY TROUBLE

On Thursday night, Amita allegedly consumed phenyl and threatened to jump off the 12th floor of the building after the couple had an argument. Harmeher remembers his father reaching home and calling his mother. "I was in the kitchen. They had an argument, and then they went upstairs. After a while, mamma went to the terrace. I saw her standing on the terrace. She was shouting. Then she called the police. Papa touched her feet... he said sorry, but she wasn't listening," he recalls." "Then she started yelling that she would jump off." Amita was admitted to Lilavati Hospital and Gurpreet was arrested on the basis of her statement to the Khar police, with whom she lodged a complaint against her husband, father-in-law and mother-in-law, alleging cruelty. She is now at her parents' house, and has asked for her children.

I DON'T WANT MAMMA

But ironically, Harmeher is not at all keen to go. "I know mamma is wrong and she should say sorry to papa. Why is my father in prison? He has done nothing wrong," says Harmeher, a Class IV student of Beacon High School. He misses his father, but says he is fine, and can take care of his younger brother and sister. He does not want to go to his grandparents' place to be with his mother. "I don't want to go there. Mamma used to go to her father's place and each time she came back, she would have a fight with papa,'' he says. This is not the first time the children are bearing the brunt of their parents' fights. In May, Amita accused Gurpreet of having an extra-marital affair and walked away with her children. "We were never allowed to speak to papa. I wasn't allowed to use my mobile. One day, when my aunt took us to Rajesh Khanna garden, I managed call up my papa. I wanted to meet him. He told me to get into an auto. Later, they went looking for me but by then I was already home. Even my brother doesn't want to go to my mother. He wants to be with me. Meher is too small, so she will have to go," Harmeher says, adding the night she was taken to hospital, Amita did not want to meet any of her children.

HARMEHER'S JUST A KID

Amita Kaur, still under observation at Lilavati Hospital, thinks her son is being tutored by her in-laws. "He is just a kid. Those people are making him say all this. Kids are kids. They will say what you tell them. Most kids are extra close to one of their parents. Harmeher is close to his father, which is all right. Why should I have a problem with that?" She says she was being harassed by her husband and inlaws. "It reached a level where I couldn't take it anymore. My husband used to tell me often that I should leave him, as he had already found another partner. He also physically abused me," Amita says. "One of the floors of the duplex is in my name. They are asking me to sign papers and give it back to them. Why should I do that?" she asks

"This part of my life... this part right here? This is called 'happyness'," Will Smith famously said after he got a job as a broker at the fag end of the Hollywood flick 'The Pursuit of Happyness'. The movie is about Smith's heart-rending struggles to land a decent job and secure his son's future. And as it turns out, most Indians are still far from Smith's 'aha' moment. 'Happyness' is something that still evades most of us.

According to the just-released Global Prosperity Index brought out by the UK-based Legatum Institute for Global Development, India fares very poorly, ranking at No 46 in the list of 50 countries ranked. Says Alan McCormick, managing director, Legatum Institute, "While India scored highly on strong community bonds, religion faith and political freedom, there is a heavy discount as far as factors like healthcare, education and economic freedom is concerned and that is dragging its overall ranking down."

According to the survey results, economic freedom in India is still a huge concern. While things have changed in recent years, India is still paying for the policies it pursued in the past. Says Sam Wilkin, senior consultant, Oxford Analytica, who conducted the data analysis for Legatum, "A lot of countries became prosperous by importing innovation and technology. But because of its policies, all these years, India has had to reinvent the wheel. But in recent years that has started to change and will soon start showing on India's ratings."

Unlike most other happiness rankings such as The University of Michigan's World Values Survey, Legatum has taken into consideration both material wealth indicators as well as life satisfaction measures. "Prosperity is not about material wealth alone and most economic indicators do not take into account true underlying measures," says McCormick. So the survey includes material wealth indicators such as growth in invested capital, low dependence on foreign aid, education, good governance, low costs of bureaucracy and economic openness; and life satisfaction drivers like freedom of choice, good health, equality of opportunity, religious faith, high levels of income, low unemployment rates and low divorce rates.

One interesting finding was that the drivers of happiness are different for developed and developing countries. Says Wilkin, "In countries where per capita income is below $10,000, income is a big driver of happiness. But once the $10,000-mark is breached, other factors such as quality of job opportunities, leisure time, etc., become more important."

All this boils down to a simple fact of life: at low income levels, survival is of utmost importance; everything else kicks in later. As people get wealthier, social bonds and human relationships suffer, and divorce rates start to rise. Hence, people start to value them more.

Interestingly, there is a three-way tie for the first place: Norway, Sweden and the US share the first slot. "This shows that there are competing models to prosperity in the world. While the US came up tops because of individual liberties, freedom of choice and strong economic indicators, Sweden scored extremely high on social indicators." Norway, on the other hand, gained ground because of competent management of the proceeds from its oil reserves that "has fostered a pace of long-term economic growth that is among the highest in the industrialised world" and also a high life satisfaction score.

Usurious Maintenance claims :
Most UN SCRUPULOUS women desert or leave their hubby and then come back claiming maintenance. This is a great cancer in India today. This is why we generally ADVICE AGAINST filing a divorce case

You claim you have filed a case for divorce on grounds of cruelty. Do you have adequate proof of the same ? Hope your case is strong enough to prove in a court of law ....

On your claim of desertion by your wife :

- Has your wife LEFT YOU on her own will ? If so is there some proof of the same ? why do I ask this question ? because ...most probably, your wife will state that you have driven her back

- IF your wife has left your home, have you called her back ?

- Are there / were there any negotiations or mediations ? and if so some evidence, witness, proof of the same ?

- Try and get proof / evidence of every act you have done to get her back ...

You should appeal against this decision and get a stay on the maintenance.

You should also cogently fight the Sec 125 Cr Pc case. For e.g. if your wife accused you of dowry demands, you should fight back forcing her to prove that you demanded dowry... so in case of her ALLEGATIONS of bad character etc etc . If she cannot prove your bad character, such false allegations by your wife itself would help you gain divorce from her.

Re maintenance case
- Was this maintenance an interim maintenance or final award ?
- Was this an ex parte decree ?
- What were the computations based on ?
- Does your wife have alternate income or assets that you can prove ?
- How did you loose the maintenance case or how was the decree actually made ?

Let it be stated at the outset that our goal is to abolish the present "lifetime" alimony (a/k/a spousal support) system with all its inequities and replace it with a system that represents the present day reality similar to those of Texas, Indiana and Alaska.


Alimony and child support are separate forms of support. This site is not concerned with child support as it is our contention that if you procreate a child, you are responsible for its support. This support requirement goes for both spouses as well. It is the responsibility for both of you to take care of and raise the child you brought into this world..


Divorce and family law is based on an antiquated social custom that it is a man's responsibility to support women because they are weaker, incapable of being equal to men, and better equipped to raise children. This is simply not the case in today's society and our laws need to be changed to reflect this fact.


In many cases, some help is justified and necessary to provide rehabilitative support to deserving spouses. But not for a "lifetime." That is unreasonable in this day and age. The way things stand with today's laws, there is abuse, invasion of your private right to determine your marital relations, the creation of a state of peonage and enslavement for the rest of your life. Read the "Right to Privacy" written by Brandeis and Warren in 1890


The goal of this site is to reveal the underlying inequity in family law. That the family laws supposedly created to provide spouses with an equitable way to dissolve their marriage are, in reality, multi-billion dollar business that benefit the family law attorneys that represent each side.


Here is a photo that kind of sums up the alimony payers situation today where the ex is having fun at the payer's expense.


It will also attempt to show you how the granting of alimony has been been subverted from its original intended purpose to that of penalizing you and providing a free life-time meal-ticket to an ex-spouse not to mention separating you from your children. With about one-third of the households now having the woman as the breadwinner, the pendulum is now swinging the other way to where women can just as likely end up paying "lifetime" alimony to the men.

- Let us say, you tell her "..I will NOT pay a penny..". Then she will have to go to a court and demand money from the husband she has to do so UNDER the CIVIL i.e. MATRIMONIAL laws of India !! correct ?

- This is where Sharia protects you as a Muslim... why ? as per sharia your maintenance (or alimony) or the amount payable to a divorced wife is LIMITED !!! Most lawyer will NOT tell you this. But ask any quadi (or mulla) or your local wakf board member and he will tell this

- I hope you understand this IMPORTANT distinction / difference

- While a Hindu Husband or a Christian Husband would fight (defend) a maintenance or an alimony suit under laws applicable to him (say Hindu Marriage act, or Special Marriage act), WHEN THE ISSUE OF DIVORCE or WHEN THE ISSUE OF TALAQ comes up, you should use Sharia

She grew up as a timid girl, tending to routine jobs at her home. Trained to take orders, execute them well and never ask for anything in return, she reeled in neglect all her life. Then came the day she thought would herald a new beginning, marked with happiness she had never known. Her husband was meant to love her, and he did.


But not enough, she mutters, digging into her nails with fatal anxiety, and rushing to her cell in Bathinda Central Jail, one of the six central jails of Punjab that house women prisoners. Charged with poisoning her opium-addict husband and two children (one survived) to death, Manpreet Sharma has been here for one-and-a-half years. Right across in the male ward is her lover, with whom she allegedly connived, to commit the heinous act that shook Bathinda. If convicted, she faces up to 15 years in prison. But her sentence has already begun, like that of several women prisoners in Punjab, charged or convicted of violent crimes like murders.


"Inmates are very hostile to her. But they have great sympathy for her children," says jail superintendent L.S. Jakhar, who always finds her quiet during rounds. In her cell, too, a piercing silence prevails, as she keeps her dark secrets to herself. By her side are scriptures, her companions on the road to redemption.


These cases abound, as Punjab jails, meant for 336 women, now house 800. In two decades, crimes by women have nearly trebled. The rot is no longer about drug peddling or dowry deaths alone, there is a potential threat from crimes of passion, with women resorting to murders for obtaining the objects of their affection.


Dr Rajiv Anand, a Mumbai-based psychiatrist working with women prisoners, explains: "Tolerance levels among women are diminishing alarmingly. They are asserting like never before. When they can't have what they want, they tend to develop dangerous impulses. These, if not contained, have potential for brutal crime. Studies in the West among women convicts show that they commit crimes during pre-menstrual periods, when hormonal changes drive them to low tolerance levels."


In all the jails that this correspondent visited, over 30 per cent murder cases pertained to killings of husbands, lovers, parents or children, by women in "love". The youngest such undertrial is Karamjit Kaur, 18, housed at Patiala Central Jail with her two sisters. Hailing from Ghanaur, she is charged with poisoning her lover who married someone else. In jail since April 20 this year, she, however, pleads, "I didn't do it. I loved him."


This jail houses several young girls, including Inderjit Kaur, a graduate from Government College, Sector 42, Chandigarh, charged with killing her mother, an employee of Punjab State Education Board, Mohali, to make way for marriage to her lover, whom her mother hated; Amritsar girl Neki Nalwa, who allegedly connived with her paramour Brandy to murder her husband, Sukhwinder, an engineer with Quark, Mohali. Sukhwinder was shot dead. Also lodged in the jail is Sonia Walia and her husband Jasvir Singh from Hoshiarpur, facing trial for allegedly killing Abhi Verma, a local jeweller's son, for ransom. Sonia faces death penalty, subject to Punjab and Haryana High Court's confirmation.


Of 80 women prisoners in Patiala jail, 53 are in for murder. At Ludhiana Women's Jail, the only all-women's jail in Punjab, this number is 80 out of 232 prisoners, says Superintendent Chander Prakash. Tragically, each one is either clueless or absolutely brazen about the act, with no psychological buffer against trauma. Each is lonely in the war against memories that come stained with blood.


The portrait of most women prisoners is much the same — each layered with silence over what happened and why; of pain over separation from family; of the fear of future.


Not a single jail has a permanent psychologist and psychiatrist on board. Ludhiana jail has a psychiatrist in the visiting lady doctor but there's no regular psychological approach to disturbed or deviant behaviour. Never mind government's stress on understanding the psychology of crime, one of the 28 aims of Punjab State Prison Policy.


Most jail superintendents even mistake smiling faces for happy ones and dismiss women's fights as routine. Patiala women's cell head Kulwant Kaur has no clue why this habitual offender Satya Devi - a Sansi - routinely pretends illness and mocks at a wasted effort. "She loves to harass us," says deputy superintendent J.P Singh and Kulwant Jaur, unaware that the convict is seeking attention, like others at six central (Jalandhar, Ferozepur, Gurdaspur, Patiala, Amritsar, Bathinda) and two district (Sangrur and Hoshiarpur) jails where women are lodged in enclosures separate from men.


In every jail, murder convicts abound, awaiting counselling. In Ludhiana, there are several - Karamjit Kaur, a widow convicted for killing her children to marry her lover; Dimple, a 26-year-old mother of six-year-old from Ludhiana, married to the younger brother of the man she killed; Manjit Kaur and her mother, who have spent 10 years in jail in a brutal double murder case reported on the outskirts of Ludhiana, along Chandigarh-Ludhiana road 11 years ago. A whopping 158 of 232 prisoners, here, are undertrials.


Across Punjab prisons, women undertrials outnumber convicts. Out of 800 prisoners, 80 per cent (560) are undertrials, some since three years. For the record, 2.5 crore cases are filed in Indian courts, annually. There are only 12,500 judges for the deliverance of justice. To be continued

From your name and E mail I assume you are South Indians. I too am from TN. My wife FILED a false 498a against me and my mother and other relatives. Ever since, I have dedicated myself to this cause.

a. You are entitled to visit the kid. As he is a male child, i.e. beyond the age of 5, if you are interested and if you are willing to fight for the same, you can even GET CUSTODY OF YOUR KID. You will have to fight for the same. Courts have started understanding such tactics by women.

- trying to separate the husband from his parents,
- money
- vengence
- trying to take away children and alienate them from the father

VIZIANAGARAM: A dowry harassment case under Section 498 (A) of the Indian Penal Code has been filed against Cooperation Minister Md Fareeduddin, his wife Razia Baig, her mother Raheema and seven others before the first class magistrate P Manga Kumari here on Saturday.

The complaint was filed by one Razia Sultana, who is married to the minister's brother-in-law, Syed Riaz. The couple were married on 15 July 2002.

Based on the complaint, the magistrate directed the police to investigate the case and submit a report to her.

Besides Syed Riaz, Razia Sultana lodged a complaint against his brothers Syed Ismail and his wife, Asra Begum, Syed Jahangir and his wife, Shaheena Begum, and Syed Nazir and his wife, Rukhsana, alleging that they were harassing her for an additional dowry of Rs 5 lakh.

Syed Riaz is currently engaged in business in Dubacharla village, West Godavari district. Razia Sultana is a native of Korukonda in Vizianagaram mandal where her father is an employee at the Sainik School. Razia Sultana had lodged a complaint with Vizianagaram rural police a few years ago but to no avail.

Sunday 01st of July 2007 Celebrated India-born author Sir Salman Rushdie and his wife Padma Lakshmi are divorcing after three years of marriage, friends have revealed.

The relationship between 60-year-old Rushdie and his 36-year-old model wife is believed to have been under strain for some months, but close friends claim that Lakshmi now regards the marriage as over, the Daily Mail reported.

Rumours that the marriage was in trouble began three months ago after one of their common friends, fashion designer Diana von Furstenberg, was overheard saying: 'I can't believe she's leaving him.'

The collapse of Rushdie's fourth marriage comes just two weeks after the announcement of his knighthood.

A close friend of Rushdie said he was 'still very much in love' with Lakshmi, but that his feelings were no longer reciprocated, the paper reported.

The couple's relationship began eight years ago after they met at a celebrity party in New York.

Rushdie's 1988 novel 'The Satanic Verses' provoked violent reactions across the Muslim world and the late Ayatollah Khomeini, the spiritual leader of Iran, issued a fatwa and death threat against him. Rushdie had to spend several years underground, appearing in public only sporadically.

Lakshmi has since branched out from modelling into acting, hosting an Italian television show, starring in a soft porn movie and writing an Indian cookery book. She also hosts a reality cooking show, 'Top Chef', on American television.

When ordinary people are accused of dowry harassment the police spring up to arrest the husband, his elderly parents, and sometimes even sisters and brothers of the husband. there are reports of even children who are dragged into such cases !!

However when ministers are accused the polices DO NO ARRESTS !! the court is ordering an investigation

VIZIANAGARAM: A dowry harassment case was filed against Andhra Pradesh cooperation minister Mohammad Fareeduddin and seven of his family members at a local court on Saturday.

Razia Sultana, the wife of the minister's brother-in-law Syed Riyad, filed a petition before the first class magistrate, alleging that Fareeduddin's family members were harassing her for more dowry.

I assume these petitions are filed at a FAMILY COURT

IF both petitions (yours and your wife's) are filed in the same court the judge has to take up both petitions together. If he does NOT, YOU MAY, repeat MAY seek them to be taken together to avoid two different dates and two different discussions

IF filed at a FAMILY COURT, Initially the Judge would send you for what is called a counseling.

At the counseling, counselors would try to get you (and your wife) to patch up

So on the first date, IT WOULD BE A QUAZI OR NON JUDICIAL talk between you, your wife and the counselors

I would advise the following in any counseling

1. Stick to the MINIMUM of facts when talking to your wife or the counsellors

1.1. Do NOT get emotional

1.2. Women try to cry - either naturally or to get sympathy. SINCE YOU HAVE FILED AN RCR, it is essential you are seen as a caring and compassionate husband. Comfort your wife if she cries. Talk in sweet and pleasing words to her.

2. DO NOT reveal your major strategies or your trump cards at this stage.

3. IF you reveal your strategies at a very early stage your opponent would try to counter them with lies and convoluted arguments.

4. The counselors are NOT lawyers. They are NOT judges. They are generally social workers or family welfare workers etc who try to help the couple patch up. So there isn't much meaning in quoting EVERY CASE LAW to them.... BUT IT IS GOOD TO KNOW THE LAW and NOT give up your rights

5. BE CLEAR OF YOUR STRATEGY
